Alaska overtime rules (AS §23.10.060)
- 1.5× for hours over 8 in a workday.
- 1.5× for hours over 40 in a workweek.
- Daily and weekly overtime are not stacked on the same hours.
- No double time in Alaska.
- Generally applies to employers with 4 or more employees; some industry exemptions apply.
Worked example
You earn $18/hr and work five 10-hour days. Each day is 8 regular + 2 overtime = 40 regular + 10 overtime hours (straight time is exactly 40, so there is no extra weekly overtime). Pay = $720 + (10 × $18 × 1.5 = $270) = $990 gross.
Frequently asked questions
Does Alaska have daily overtime?
Yes. Alaska is one of the few states with daily overtime. Non-exempt employees earn 1.5× their regular rate for hours worked over 8 in a single workday, and over 40 in a workweek. Daily and weekly overtime are not paid on the same hours — you get whichever is greater.
Which employers does Alaska overtime apply to?
Alaska daily overtime generally applies to employers with four or more employees. Some industries and roles are exempt (for example certain agricultural, small-employer, and executive/administrative positions). When in doubt, check with the Alaska Department of Labor.
Does Alaska have double time?
No. Alaska overtime is paid at 1.5× the regular rate. There is no state double-time (2×) requirement.
How is Alaska overtime calculated for a long day?
Hours over 8 in a workday are paid at 1.5×. For example, a 10-hour day is 8 regular hours plus 2 overtime hours. Across the week, weekly overtime (hours over 40) is then applied to the remaining straight-time hours so the same hours are never counted twice.
