California overtime rules (Labor Code §510)
- 1.5× for hours over 8 and up to 12 in a workday.
- 2× (double time) for hours over 12 in a workday.
- 1.5× for hours over 40 in a workweek (straight-time hours only — not double-counted with daily overtime).
- 7th consecutive day: 1.5× for the first 8 hours, 2× beyond 8.
Worked examples
Daily overtime: five 10-hour days at $20/hr = 8 regular + 2 overtime each day = 40 regular + 10 overtime hours (straight time is exactly 40, so no extra weekly overtime). Pay = $800 + (10 × $20 × 1.5 = $300) = $1,100 gross.
Double time: one 14-hour day at $20/hr = 8 regular + 4 overtime (hours 8–12) + 2 double-time (over 12) = $160 + (4 × $20 × 1.5 = $120) + (2 × $20 × 2 = $80) = $360 gross.
Frequently asked questions
How does California overtime work?
California uses daily AND weekly overtime. You earn 1.5× after 8 hours in a day and after 40 hours in a week, and 2× (double time) after 12 hours in a day. On the 7th consecutive day worked in a workweek, the first 8 hours are 1.5× and anything beyond 8 is 2×. You are paid the rule that benefits you most — daily and weekly overtime are not stacked on the same hours.
When does double time apply in California?
Double time (2× your regular rate) applies after 12 hours in a single workday, and beyond 8 hours on the 7th consecutive day worked in the same workweek.
What is the 7th consecutive day rule?
If you work all 7 days of a single workweek, the 7th day is paid at 1.5× for the first 8 hours and 2× for any hours beyond 8 — regardless of the daily total on the other days.
Does this calculator include meal and rest break premiums?
No. California meal and rest break premiums (one extra hour of pay when a required break is missed) are separate from overtime and are not included here. This tool computes overtime and double-time hours and pay only.
