Colorado overtime rules (COMPS Order)
- 1.5× for hours over 40 in a workweek.
- 1.5× for hours over 12 in a workday.
- 1.5× for hours over 12 consecutive hours worked.
- You are paid whichever calculation gives the most overtime — not all three stacked.
- No double time in Colorado.
Worked example
You earn $20/hr and work four 13-hour days. Each day has 1 hour over 12 = 4 daily-overtime hours; that leaves 48 straight-time hours, and 8 of those are over 40 for the week. Total: 40 regular + 12 overtime hours. Pay = $800 + (12 × $20 × 1.5 = $360) = $1,160 gross.
Frequently asked questions
How does Colorado overtime work?
Under the Colorado Overtime and Minimum Pay Standards (COMPS) Order, non-exempt employees earn 1.5× their regular rate for whichever of these produces the most overtime: hours over 40 in a workweek, hours over 12 in a workday, or hours over 12 consecutive hours. You are not paid twice for the same hours.
Does Colorado have daily overtime?
Yes. Colorado is one of the few states with daily overtime: 1.5× after 12 hours in a single workday (or 12 consecutive hours). This is on top of the standard 1.5× after 40 hours in a week, and you get whichever is greater.
Does Colorado require double time?
No. Colorado overtime is paid at 1.5× the regular rate. There is no state double-time (2×) requirement.
What is the difference between 12 hours a day and 12 consecutive hours?
The COMPS Order counts both: more than 12 hours in a single workday, and more than 12 consecutive hours of work (which can cross midnight into the next calendar day). This calculator applies the rule using the hours you enter for each day; if a long shift spans two days, enter the hours in the day the shift began for the closest result.
